GENERAL

COOKIES
Viewfruit may set and access cookies on your computer. A cookie is a small data file that a Web site may send to your browser and which may then be stored on your system. We use both session cookies and persistent cookies. For the session cookie, once you close the browser, the cookie terminates. A persistent cookie is a small text file stored on your hard drive for an extended period of time. Persistent cookies can be removed by following Internet browser help file directions. We use cookie and web beacon technology to track which pages on the Viewfruit Site our visitors view and which Web browsers our visitors use. Cookies help us track your responses to our market research surveys, to record statistics behind special offers, however, we will never share such personally identifiable information with third parties except as set forth below under “Sharing.”
MARKET RESEARCH
We may also share your personal information and/or social-demographic information, including, without limitation, a unique identification number (“UID”), postal code, gender, marital status, education, ethnicity/race (where permitted by applicable law), employment related information, and non-personally identifiable information on household members, with third party sample/market research companies (individually each a “Third Party MR Company” and collectively the “Third Party MR Companies”) for the purpose of identifying survey opportunities that you may be eligible for through the Third Party MR Companies. If you are eligible for a survey opportunity, the Third Party MR Company will provide your unique identification number and a survey link to us and we will invite you to participate in the survey. We will not share your name, email address, or phone number with the Third Party MR Companies. In connection with the sharing of your information with a Third Party MR Company, your information may be transferred and stored outside of your country of residence. Your participation in such survey opportunities does not entitle you to any benefits offered by, or membership with, the Third Party MR Companies.
SHARING
Though we make every effort to preserve your privacy, we may need to disclose personal information when required by law, where we have a good-faith belief that such action is necessary to comply with a judicial proceeding or administrative legal, a criminal investigation, a court order, or legal process served on our Web site. We may also share your personal information if we believe it is necessary in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of Viewfruit, or as otherwise required by law.
BUSINESS TRANSITIONS
In the event Viewfruit goes through a business transition, such as a merger, being acquired by another company, or selling a portion of its assets, users’ personal information will, in most instances, be part of the assets transferred, unless such a transfer will violate state or federal law.
OPT-OUT
You may unsubscribe from offers and other communications from the Company by clicking "Remove Account" on Viewfruit or by emailing us at Viewfruit Contact Email. We will process your request for removal within 10 business days, although we attempt to process it within 24 hours.
CHANGES TO THIS PRIVACY POLICY
Viewfruit may update this policy. We will notify you about significant changes in the way we treat personal information by placing a prominent notice on our site.
PERSONAL INFORMATION WE COLLECT
• Personal Profile Information. The Join / Sign Up form collects your first and last name, your email address and your chosen password. If you Sign Up via Facebook or any other social media platform, we also collect this information.
• Contact Information. If you opt to receive surveys via text-message or other messaging media we also collect your mobile phone number or relevant contact details.
• Questionnaire Data. The initial profiling questionnaire collects information about your background, education, working status, consumer habits and, optionally, your health. We collect information about any updates you make to your profiling information.
• Opinion Data. During research opportunities we collect information you provide relating to your opinions, attitudes, experiences and use of certain products or services. Occasionally we may collect video, audio or photographic submissions you make during a research opportunity.
• User Experience Data. We collect information about your logins, comments on blogposts, ratings, polls, web pages viewed.
• Rewards Information. Any personal information we may require in order to issue you with a prize or reward or monitor your usage of our credit point scheme.
• Correspondence Data. Any correspondence you send us.
• Social Media Information. Information you provide to us via social media or through your social media feed.
Generally, we collect Personal Information when you provide it to us by visiting the Viewfruit site and Features or using our Services. This may include registering for any account with us, filling out surveys, joining a mailing list, or otherwise volunteering or providing information about yourself. We may use your Personal Information and other information we collect about you in order to provide you with our Services, to improve the Viewfruit site and Features, to provide advertising, content, surveys, offers, promotions, and rewards, and for other marketing, administrative and general business purposes as described in this Privacy Policy.
If you don’t provide us with your Personal Information, we will generally be unable to provide you with our Services and you will be unable to use the Viewfruit site and services.
DELETION OF YOUR PERSONAL INFORMATION
You may request that we delete the Personal Information that we collected about you. By asking us to delete your Personal Information we will have to close your account and you will no longer be able to use the Viewfruit site and Features or our Services. Please note that your Viewfruit account cannot be reinstated once it has been deleted.
If you want to delete your Viewfruit account, please submit your requests by: (1) Emailing us at Viewfruit Contact Email; (2) Clicking the "Remove Account". We will process your request for removal within 10 business days, although we attempt to process it within 24 hours.
Additionally, we are fully compliant with the General Data Protection Regulation (GDPR) and all other applicable data protection legislation. GDPR legislation provides individuals with a number of rights in relation to their personal data. You have the right to request access to the personal information that we hold about you, to ask for personal information to be corrected if you believe it to be incorrect, to ask for your personal information to be erased and to ask us to stop processing your personal information.
APP
When you download and use the Viewfruit mobile Android app, we automatically collect system and performance information about your device, including but not limited to, the device's Model, Advertising ID, Android version, Operating System, and App version. We use this information for validation purposes and fraud detection and/or prevention, including, without limitation, identifying duplicate or fraudulent users.
COOKIES AND ADVERTISING TECHNOLOGIES
In addition to the ad networks, we may set (or allow third parties to set) and access cookies and other similar technologies, such as web beacons and embedded scripts, on your computer. A cookie is a small data file that a website may send to your browser and which may then be stored on your system.
Web beacons and embedded script are invisible images or other programming code, which may be used on the Viewfruit site and Features for a variety of analytical purposes and to help us provide a better and more customized user experience, including, without limitation, providing personalized features and preferences to you within the Viewfruit site and Features; in doing so, we may link the information we collect from cookies and other similar technologies with your Personal Information and may track your browsing activity on our merchant partners’ website in order to provide you with advertising, content, surveys, offers, promotions and rewards, and for other marketing, administrative and general business purposes.

《Viewfruitユーザー協議》

第１条会員サービス総則

1. Viewfruit（以下「本ステーション」と称する）或いは本ステーションと協力する法人が、本ステーション或いはアンケート調査を求める人（以下「クライアント」と略称する）の為に行うインターネット調査、携帯調査、グローバル調査及び他の調査サービス（以下「本サービス」と略称する）について、本協議は第二条に定義された本ステーションが審査を経て同意した登録調査会員対象（以下「調査会員」と略称する）と本ステーションとの契約書関係を定めています。

2.本ステーションは本ステーション或いはクライアントの為に本サービスを実施します。その内容は：本ステーション或いは本ステーションと協力している法人が運営し管理するウェブサイト（以下「本ウェブサイト」と略称する）でアンケート調査のための専用ホームページを設置し、調査会員は相応なアンケート調査に答え、本ステーションはその結果を収集し、分析します。又、各アンケート調査の目的に基づいて、本サービスは特定の調査対象にアンケート調査を送りますが、本ステーションに登録した会員全体にアンケート調査を送るとは限りません。
3.本サービスの目的は：本ステーションが別途で決めた調査回答者数を限りに、特定の調査対象からの回答情報を収集しますが、本ステーションのアンケート調査から依頼を受けた調査対象全体にアンケート調査に答える権利を与えたということにはなりません。
4.本サービスは、日本国内で住んでいる人を対象にしております。日本国外に住んでいる人（日本国内に住んでいる人であっても、一時的に国外のネットワークから本ウェブサイトを訪問し、或いは国外のサーバーを利用して本ウェブサイトを訪問すれば、国外に住んでいる人と見なす。以下同様）は、登録する権利を含んだ調査会員として使える一切の権利を持ちません。また、本ステーションは、調査会員或いは調査会員希望者が日本国外から本ウェブサイトへの訪問を制限することができます。

5.本協議のほかに、本ステーションが適当だと判断した方法、手段によって制定、変更、或いは修正した後の調査会委員に向けて告知した各規定は本協議の一部となります。また、本ステーションはアンケート調査を実施するとき、調査会員に送ったメールとアンケート調査で会員に知らせた各条件も、当規定に属します。

6.前もって調査会員の同意を得なくても、本ステーションは自由に本協議及び前の規定の各項目を改正することができます。改正後の本協議などについて、本協議は本ウェブサイトになった時点で発効し、その他のかく規定は調査会員に告知通知を送った時或いは本ウェブサイトに載せられたよりやはい時期から発効します。

7.本ステーションが別途で制定した各規定の中で、もし本協議と衝突している規定があれば、本協議を優先させます。

8.調査員登録に希望した人が登録手続きを終えた後、本ステーションが調査員の登録を認可した時点で、調査員は本協議に同意し、そして調査員に適応できると見なします。

第２条 調查員の資格

1. 調査員の定義は：本協議に同意し、そして本ステーションによって規定された登録手続きを終えた時、本ステーションによって認可された人。また、調査員登録希望者は以下のどれかの状況に合ったとき、登録はできません。

a. 年齢は１６未満の場合

b. 日本の国外に住んでいる場合

c. すでに登録した調査員と同じメールアドレスを使って登録をしようとする場合

d. 本サービスと同じような企業で関連職に努めている本人或いは家族が調査員に登録したい場合

2. 調査員に希望した人が、本ステーションによって調査員の登録を拒否されたとき、本人がすでに登録手続き終えた或いは本ステーションの審査に通過したにもかかわらず、本ステーションは調査員登録を取消、或いは調査員の資格を取り上げることができます。

第３条　調査員の登録方法

1. 調査員の登録手続きに関しては、希望者本人がするべきであり、代理登録はできません。

2. 調査員登録希望者が本協議に同意した後、指定された「調査員新登録グラフ」に必要事項を書き入れた後で調査員に登録します。調査サービスを受け取るために本ステーションは審査を受けた対象に登録ユーザー名とパスワードを送ります。

3. 調査員に登録する際、登録情報のあらゆる項目について、調査員はいかなる虚偽情報も書いてはなりません。

4. 調査員は複数の登録ユーザー名とパスワードを持ってはなりません。

第４条登録ユーザー名とパスワードの管理

1. 調査員が登録した後、本ステーションが提供したアンケート調査を答える時、本ステーションが前の条目によって送ったログインユーザー名とパスわードを使うべきである。

2. 本ステーションに登録した際に出した登録ユーザー名とパスワードの管理及び使用は、調査員がすべての責任を負うことになります。

3. 調査員は譲渡、貸出、名義変更、売買或いは他の形で第三者に本ステーションの登録ユーザー名とパスワードをていきょうしてはなりません。

4. 調査員がログイン或いはパスワードの使用のミスで、第三者によって損害が出た時、調査員の責任かどうかにかかわらず、理由を問わずに本ステーションはいかなる責任も持ちません。

第５条調査員の登録情報

1. 調査員の登録情報に含まれる名前/アドレス/電話番号/メールアドレスなどの調査員個人を識別できる情報について、本ステー損が別途で制定した「プライバシー政策」によって操作します。又、本ステーションは以下の各項目の中で相応の個人情報を利用することができます。そして、もしこれらの事項以外の目的で個人情報を使う必要があるとき、事前に調査員の同意を得てから利用できます。

a. 本サービスの実施或いは運営

b. 本サービスにかかわる報酬、景品、調査サンプルなど

c. 調査員からの電話、メールなどの問い合わせ

d. 以上の事項にかかわるその他の付属業務

2. 本人の同意を得ないで、調査員の個人情報を識別できる情報以外の登録済み調査員の情報を第三者に提出する可能性があります。調査員個人を識別できる情報に関しては、第三者に公開、或いは提供する必要があるとき、本ステーションは前もって調査員本人の同意を求めるようにします。

3. 前の規定とは別で、以下の目的に限って、事前に調査員の同意を得なくても、本ステーションは制定された基準に基づいて、一定の委託サプライヤーに調査員を識別できる個人情報を利用させることができます。また、本ステーションと当サプライヤーの間は機密厳守協議を結び、そして当サプライヤーが機密厳守協議を厳しく遵守することを確保するべきです。同時に、当サプライヤーが当情報を利用するとき、本協議の内容をも遵守するべきです。

a. 本サービスと関係のある報酬、景品、調査サンプルなどを送る時

b. 調査員からの電話、メールアドレスなどの問い合わせに対応する時

c. 携帯調査、グローバル調査を実施或いは運営するとき、或いは集団の形式でインタビュー調査を行う時

d. 以上の事項と関わるその他の付属業務

4. 調査員のアドレス、電話番号或いはその他の登録情報の変更が起こった時、即座に本ステーションの制定した変更手続きを取るべきです。

5. 本ステーションが必要だと判断した時、電話、メール或いは他の手段で調査員に以下の内容を確認することができます：情報登録した人は登録者本人である；登録情報の内容は精確である；アンケート調査の回答内容はくわしいであるなど。

6. 調査員は登録後、本ステーションが定期的に実施する情報更新手続きについて、調査員は本ステーションの決めた期間内で更新手続きを取るべきです。また、当期間中に更新手続きを取らなかった場合、本ステーションが当時まで調査員に送ったポイントは全部無効となります。

第６条調査員の禁止されるべき行為

1. 調査員は以下の行為をしてはならなく、また以下の行為をする可能性もあってはなりません。

a. 公共道徳に違反する行為

b. 日本の関連法律と法規に違反する行為

c. 本ステーション、他の調査員或いは第三者の著作権、肖像権、プライバシー、財産などへの侵害行為

d. 本ステーション、他の調査員或いは第三者を誹謗する行為

e. 本ステーション、他の調査員或いは第三者に損失をもたらす行為

f. 本サービスの運営を妨げる行為

g. 虚偽或いは事実に反する情報を使って登録し、或いは調査を答える行為

h. 本ステーションの同意を得ずに、本サービスでの販売行為或いはその性格は販売性を持つ行為

i. 同じ人が繰り返して登録する行為、或いは別人を装って登録する行為

j. 登録ユーザー名とパスワードを違法的に利用する行為

k. 違法的に回答する行為

l. 第７条に規定された機密厳守義務に違反する行為

m. 他の本ステーションが適当ではないと判断した行為

第７条調査員の機密厳守義務

1. アンケート調査によって知ったアンケート調査のダイジェスト或いは内容などアンケート調査にかかわる一切の情報に関しては、調査員がアンケート調査に回答したかどうかにかかわらず、調査員は機密厳守義務があり、第三者に見せたり、或いは漏洩したりしてはなりません。

2. 前の機密厳守義務の定義は：いかなる手段/方法で本ステーション及び調査員以外の第三者に、アンケート調査の関連問題の内容或いは他の方法を通して知った情報、及び本ステーションで使われる文書データ、画像データ、ビデオデータ或いはその他のすべてのデータ、及びアンケート調査に向けての回答を見せ、或いは漏洩してはなりません。アンケート調査以外の目的で以上のデータを使用/転用してはなりません。

3. 本項目に規定された機密厳守義務については、第１１条の撤退手続き或いは第１２条に規定された調査員資格をログアウトした後でも、依然として有効で続けます。

第８条メールアドレスの受付

1. もし調査員が本ステージとメールのやり取りをする場合、調査員が使うメールアドレスは登録当時に申し込んだメールアドレスと一致するべきです。

2. 調査員が登録情報と違ったメールアドレスを使ってメールのやり取りをすることで蒙った損失と損害について、本ステーションはいかなる責任も持ちません。

3. 調査員が本ステーションのメールに返事する時、本ステーションが別途で指定した方法で返事すべきです。

4. 調査員が本ステーションに指定された方法でメールの返事をすることで損失或いは損害を被った時、本ステーションは責任を持ちません。

5. 調査員が送るメールの中の文章の内容について、本ステーションには責任がありません。

6. 本ステーションが調査員に送ったメール或いは調査員が本ステーションに送ったメールが遅れ、或いは届かなかったことで調査員に損失或いは損害をもたらした場合、本ステーションはいかなる責任も持ちません。

7. 本ステーションが調査員に送ったメールは一定の期間内で届いていない場合、調査員の同意がなくても、本ステーションはメールの発信を暫く停止し、或いは調査員資格を取り消すことができます。

8. 本ステーションが特定の調査員に送ったメールの内容は、当調査員だけに送った内容と見なすべきであり、本ステーションが別に規定しない限り、当調査員は本ステーション及び調査員本人以外の第三者に当内容を転送してはならく、そして特定ではない多数の人に当内容を公開してはなりません。

第９条回答の報酬

1. アンケート調査に回答した報酬として、本ステーションは調査員に謝礼金を提供し、或いは景品と交換できる本ステーションに規定されたポイントをあげる可能性があり、或いは抽選で景品を提供します。

2. 第１項に規定された報酬の種類、提供方法及び提供期間に関しては、アンケート調査によって本ステーションが別に規定します。

3. 景品と交換できるポイントを持っている調査員は第１１条の規定によって退会する時、当調査員の獲得したポイントについて、本ステーションが別に規定した方法で清算する場合を除いて、退会が成立した時点で失効します。また、第１２条の規定によって、調査員が調査資格を取り消される時、当調査員は調査の資格を失い、すでに獲得したポイントも全部無効となります。

4. 景品などの抽選は本ステーションが別に制定した方法で行います。ポイントの計算は本ステーションが別に規定した計算方法で計算します。

5. ポイントはただ当ポイントを獲得した調査員にとって有効であり、第三者にポイントを譲渡したり、売買を怒ったりしてはならなく、また多数の登録ユーザー名のポイントを合計することもできません。

6. 抽選及びポイントの交換景品の配送アドレスについては、日本国内でしかも本ステーションに登録した調査員の現有のアドレスに配送します。調査員の登録情報の間違いなどで景品が届かない場合、本ステーションはいかなる責任も持たなく、また再び送ることもありません。また、この場合、景品交換などに使うポイントも無効となります。

7. 調査員が、本ステーションからの発信済み及びポイントとの交換に関する通知を貰ってからの６０日間内で景品が届いていない場合、本ステーションと連絡してください。当通知が送られた後の１２０日間内、もし調査員には景品が届いていない場合、調査員の登録情報が間違っているかどうかにかかわらず、本ステーションはいかなる責任も持ちません。

8. 調査員の登録情報の間違いで調査員の指定したpaypal口座にポインとの交換金額を振り込めない時、本ステーションはいかなる責任も持ちません。

第１０条権利の帰属

1. 本ステーションが調査員に送ったすべての情報の関連著作権とその他の一切の権利は、本ステーション或いは顧客或い他の事業者に属しており、情報を提供したことは、調査員にその権利を授与するとは意味していません。本ステーションの許可がないと、調査員は当情報を利用してはなりません。

2. 調査員が本サービスに基づいて本ステーションに回答したアンケート調査のすべての情報（以下「回答情報」と称する）に関する著作権及びその他の一切の権利は本ステーションに譲渡すべきであり、本ステーションは自由に当回答情報を選択、修正及び編集することができます。また、調査員は本ステーションに対して当著作権と関連する著者資格権利を行使してはなりません。

3. 本ステーション或いは顧客或いは本ステーション/顧客の指定者は回答情報を利用することができます。調査員の同意がなくても、第三者に回答情報を提出、提供することができます。

第１１条退会

1. 調査員が退会する時、本ステーションの規定した手続きを終えてからしなければなりません。調査員が退会手続きを終えた後、退会が成立します。本ステーションは一定の期間内で調査員が登録する際に使った、謝礼金を送り、景品を交換し、及び調査員に各種の問い合わせの確認の為の調査員情報を保留します。その後また本ステーションのデータベースから当情報をすべて削除します。

2. 調査員が退会すると、直ちに退会する前持っていたすべてのポイント及び本サービスに関する一切の権利を無くします。そして本ステーションに対して一切の要求権も持てません。

第１２条条フォロー調査人資格の一時停止/取消

1. 調査員は以下の行為があった場合、調査員に事前に同意を求めなくても、本ステーションはアンケート調査の発想を停止し、或いは一時調査員資格を停止/取り消すことができます。

a. 第６条の禁止行為に違反した場合

b. 前の条目以外、あらゆる本協議及びその他の本ステーションが制定した各規定に違反した場合

c. 本ステーションが、アンケート調査に対して間違った矛盾する回答、重複登録、偽証登録などほかの以上行為或いはこの種の行為の可能性があると判断した場合
d. 本ステーションが、アンケート調査を停止し、或いは一時調査員資格を停止/取り消すほうがいいと判断したほかの状況

2. 本ステーションがアンケート調査の発送を停止し、或いは一時調査員資格を停止/取り消した時、調査員の持つ本サービスと関連するすべての権利をも一時停止/取り消すことができます。この場合、本ステーションは調査員に、アンケート調査の発送を停止し、或いは一時調査員資格を停止/取り消すことを知らせる義務はありません。また当措置について調査員に関連理由を答える義務もありません。調査員は前もって本項目を知っておくべきです。

3. 本ステーションが調査員の資格を取り消す時、当調査員を識別できる個人情報、当調査員に授与したポイント及び当調査員が登録手続きを取る時に登録した情報をすべて削除します。

第１３条責任

1. 本サービスの中で、サンプルを使って試用する必要があって調査員にアンケート調査を依頼した時、調査員は本ステーションに指定された方法と期間で当サンプルを使うべきです。もし、調査員が本ステーションの指定した方法と期間外でサンプルを使ったことで、損失或いは損害を被った時、本ステーションはいかなる責任も持ちません。

2. 通信線路とコンピューター故障などで本サービスの中断、伸ばし、中止、データ紛失、訪問データ錯誤などが出て、当調査員に損失或いは損害をもたらした時、本ステーションはいかなる責任も持ちません。

3. 調査員が本協議に違反したなどで、本ステーション或いは第三者が損失を被った場合、調査員の持っているすべてのポイントは失効します。本ステーションは景品を提供しないうえに、当調査員に損害賠償を求めることができます。

第14条 本サービス内容の変更及び一時的の中断、停止と中止

1. 調査員の同意があるかないかにかかわらず、通知がなくても本ステーションは随時に本サービスの内容を変更し、また本サービスを一時中断、停止及び中止することができます。

2. 前の条目をもとに、内容の変更及び一時中断、停止及び中止のため調査員が損失或いは損害を被った場合、本ステーションは責任を持ちません。

第15条法律本拠

1. 本契約書の締結、執行、解釈及び紛糾の解決は、全部日本の法律に適応します。

第16条専門管轄裁判所

1. もし本ステーションが調査員と本協議について紛糾が起こった場合、Viewfruitを管理する所在地の裁判所に訴訟を起こすことができます。

第17条分離可能性

1. 管轄権を持つ裁判所は本協議のある条目を違法或いは無効と判定したところで、当条目以外の本協議の効力には影響がありません。

（附則）

制定及び更新： 2012年02月01日
